Effective March 5, 2020 Windhaven National Insurance Company (“WNIC”) was ordered into liquidation by District Court in Travis County, Texas. The Texas Department of Insurance (“Department”) is the court appointed liquidator of WNIC.  A copy of the liquidation order is available on the Department’s website, https://www.tdi.texas.gov/lorc/officesofsdrs.html

With the entry of the liquidation order, the Florida Insurance Guaranty Association (“FIGA”) has been activated to help pay outstanding Florida claims for property and casualty policies. The processing and payment of covered claims will be made by FIGA (subject to the lesser of policy limits or FIGA’s maximum cap). The maximum amount FIGA will cover is generally $300,000 per claim.  For more information see the FAQ section of this website or the Texas Receivers website. No claim will be paid in excess of this cap. All claims are subject to a $100 statutory deductible over and above any deductible identified in the WNIC policy. A policyholder may file a claim in the WNIC receivership for the $100 deductible and for amounts over the cap.

Claimants who need to check on the status of an existing claim or to report a new claim should call the Florida Insurance Guaranty Association at (800) 988-1450 (toll-free). The Texas Special Receiver (“SDR”) is working on transitioning claims over to FIGA who may not have all information available to service your claim at this time.

To report a NEW claim or REOPEN an existing claim previously handled by an insolvent company email FIGA at nclaim@agfgroup.org or fax 850-523-1888. You will need to provide the following information:

  • Policyholder’s Name
  • Claimant’s Name (if not policyholder)
  • Policy Number
  • Claim Number (Reopen only)
  • Date of Loss
  • Brief description of the loss
  • A copy of the police, incident or exchange report
  • Requestor’s best contact information (email & phone)

All policyholders should be informed that per Section 631.68, Florida Statutes, the deadline for settling a claim or filing suit against FIGA is September 7, 2022.

Premium Refunds/Unearned Premium:

FIGA will pay unearned premium claims after the Texas Receiver completes its processing of the policy records and sends the unearned premium records to FIGA.  A $100 per policy statutory deductible applies to policy refunds and will be deducted from the amount paid.

The Hearth Group and Windhaven Insurance Services, LLC were managing general agents owned by the same parent company that owned WNIC. They are not insurance companies. If your policy was issued through one of these groups, contact the insurer listed on the declarations page of your policy with any questions.
